Not quite everything we needed, but it will aid to prevent
outleast OUTRIGHT ballot cheating. Thank goodness for
some semi-reasonable judges. Supposedly a poll taken
today has Bush up 2-5 points in Ohio, I'm still looking for
the actual poll and source.

The link to FoxNews only says the ruling has been appealed, not overturned. I see nothing on the site, Drudge, AP Breaking News, Google News, or Yahoo! that says any decision has been handed down on the appeal.

I've heard nothing to suggest that the sixth circuit has done anything about the district courts' decisions.

My bad, here is another link.

It was overturned by the Ohio State Supreme Court, which
assumes jurisdiction in a matter of state law.

I heard it too. This is good news. The Democrats act like we're trying to suppress voters simply because we challenge "gasp" illegal voters. Alan Colmes was ALL upset because we dare to require identification at the ballot box. Are these people for real?

Alan Colmes was ALL upset because we dare to require identification at the ballot box. Are these people for real?No, they're liberals. They live in their own LaLaLand, utterly isolated from reality. Identify voters on whom the future of America rests? Unthinkable! Why, that would put an unacceptable damper on RAT voter fraud.

I suspect that Colmes is Hannity's comic relief, akin to Stimpy to Ren or Pinky to the Brain.

Since federal District judges had prohibited challenges, it was up to the 6th Circuit Court of Appeals to overturn it. They did, just over an hour ago:

A three-judge panel of the 6th U.S. Circuit Court of Appeals ruled 2-1 to grant emergency stays of two federal judges' orders Monday that barred voter challengers from political parties. The judges also consolidated the two appeals, which stemmed from separate lawsuits in Cincinnati and Akron.



Alphonse Gerhardstein, attorney for the plaintiffs in the Cincinnati case, said early Tuesday that he appealed the 6th Circuit decision to the U.S. Supreme Court.



The federal appeals court said that while it's in the public interest that registered voters cast ballots freely, there is also "strong public interest in permitting legitimate statutory processes to operate to preclude voting by those who are not entitled to vote."

The judges also said that smooth and effective administration of the voting laws means that the rules can't be changed in the hours immediately preceding the election.

Justice Stevens, being the Supreme Court justice assigned to the 6th Circuit for emergency appeals, issued an in-chambers opinion in which he refused to hear the appeal. It's highly unlikely that the full Court would vote to take the case (and thus, in a sense, "overrule" Justice Stevens), especially since Justice Stevens is one of the most liberal justices on the Court.
