I know this case and this guy was messed up bad. But, how much is too much?? Should there be limits on tort recoveries?

Indiana Court Upholds $55 Million Judgment Against Kroger
The Associated Press

INDIANAPOLIS (AP) - The Indiana Court of Appeals on Wednesday upheld a jury award of $55 million for an Illinois man injured when he was crushed between two trucks in a warehouse parking lot.
Jerry Stanton had sued the Kroger Co. and one of its truck drivers, accusing them of negligence after he was crushed between two trucks when a tractor trailer backed into him in May 1995.

Attorneys said the jury award, issued in September 1999 after a two-week trial, was one of the largest verdicts ever in Indiana.

Witnesses said Stanton, a driver with an Illinois trucking firm, parked his truck in the parking lot of a Kroger's warehouse in Indianapolis, then walked across the lot to read a nameplate on a semi trailer.

As he stood by the trailer, a Kroger driver backed his tractor rig up to hook onto the trailer, crushing Stanton between the two vehicles. Witnesses said the Kroger driver was going too fast.

The Court of Appeals said the trial court did not abuse its discretion when it denied Kroger's motion to dismiss the suit for lack of jurisdiction. The appeals court also said it was not convinced the jury award was excessive.

Kroger, based in Cincinnati, is the nation's largest supermarket operator, with 2,354 supermarkets and multi-department stores in 31 states.
