So he's guilty of raping the 13 year old boy but jury still out on murder.

Jury Convicts Man of Rape, Tries Again at Second Count

BENTONVILLE, Ark. (AP) - A jury convicted a man of raping a 13-year-old boy who died in his apartment but was undecided Thursday on a murder charge.
Judge David Clinger directed jurors to try again to settle whether Joshua Macabe Brown was innocent in the death of Jesse Dirkhising or guilty of capital murder, first- or second-degree murder or manslaughter.
The jurors were split 10-2 when they quit Wednesday, but did not disclose further details.
The rape verdict, reached Wednesday and unsealed Thursday, will stand even if jurors cannot reach a decision on the other charge. If the deadlock remains, prosecutors will have the option of retrying the case.
The rape charge carries two possible prison sentences: 10 to 40 years or life. The judge can decide the sentence if jurors are unable to agree.
