Will Judge Michael Luttig or Alberto Gonzales be George Bush's first nominee to the Supreme Court?

Luttig currently sits on the U.S. Circuit Court of Appeals for the 4th Circuit. Previously, he clerked both for Warren Burger and for Antonin Scalia, and he has headed the Justice Department's Office of Legal Counsel.

Alberto Gonzales and Emilio Garza are also under consideration, either would be the first Americans of hispanic descent to be nominated. Gonzales is currently Bush's White House Counsel.

Luttig would be an extremely tough confirmation. Luttig wrote the decision which declared VAWA unconstitutional, which means NOW would go ape-shit over a Luttig nomination--probably not as bad as Clarence Thomas, but close to it. Given the composition of the Senate it would be a close vote, but there probably are enough conservative Democrats who would cross-over to confirm.

Given how no justices have shown any indication that they plan on stepping down any time soon (at least not this year), Bush's first choice will probably depend on the outcome of the 2002 elections (especially given that the party of the president usually loses a couple of seats in the midterms).

Gonzales. Luttig will be a lightning rod just for the fact he clerked for Scalia. Gonzales will sail thru, the dems not wanting to upset hispanic voters.
