Passing now.
I'm trying to get a definitive writing on what exactly passed. Apparently what they passed allows the matter to be heard in federal court.
edit: a federal judge can decide if the tube will be re-inserted. They want a federal judge notified immediately.

Yes, but the numbers look right for us. There's a couple more minutes to vote. Suspend the rules and pass is done when they know they have the votes to overwhelm the opposition.

The voting is over. They passed it. It looks like all they needed was quorom present and called for the vote. Republicans present voted 151 aye and 3 nay, Democrats present voted 46 aye and 52 nay.

Now W needs to sign it and then they need to go wake up a judge in the 11th Circuit. Maybe they should wait until morning. :D
I'm sure Felos is ready to file in federal court to declare the law unconstitutional just as he did with Terri's Law when Jeb got it passed in FL in '03.
So we're not out of the woods yet but just getting it into federal court is helpful because of the procedural review of Greer's actions. Evidence that he ignored or made ethically questionable decisions on can be introduced.

He'll still have to review the case. That's important. It puts the batteries in the flashlight needed to shine light on the case.

But as this simply gives standing to the federal courts, it's a different kind of law, so, hopefully, it will have a better chance of surviving scrutiny by the courts

Question: Since our state courts are now moot, does that mean I can disregard all but federal laws? Forget pulling over for anyone but a U.S. Marshall, since the states and local jurisdictions have no authority.

Nobody said it was final victory. But it's certainly better than the present legal condition. It's a big step.

I'm not a lawyer, but I don't think you mean stare decisis. I think you mean res judicata.
Stare decisis is about precedent. Res judicata is about a case already being decided.

This legislation doesn't make state courts moot. It just means one crooked judge might have his ass gone over with a fine-toothed comb. :thumb: :prolife:

What this is about is political grandstanding by the Republicans for a political poster child and the establishment of a precedent that any single person can petition the United States Congress for redress on any individual case if that individual feels he or she did not get a fair shake by the state judiciary.
Do you really think all of those Reps at the mic really care about Terri as an individual? C'mon. Several of them couldn't even pronounce her name. Sensenbrenner couldn't get Terri's name right or her parents. Yet they claim to be such experts on the case in a few days (as some on this board do) that they can offhand dismiss seven years of court proceedings at the state and federal level.
Here's the irony.
The Reps just netted millions and millions of dollars for lawyers around the country (and we know how Reps LOVE lawyers) and increased the documented declarations of desires for death in such cases exponentially.

The pro-states rights folks today were all for the federal government stepping in when their abortion rights were being taken away by states. I'm pro-states rights myself but we have a runaway judiciary in Florida.

Brenda I too am another pro-states rights person, but I have to agree with you here on this, that we as a nation are suffering from judicial activisms abuse.
The judges in this nation MUST be limited soon, or we will end up under a judicial tyranny.
This was what our Founding fathers of this nation feared most, an unaccountable unelected judiciary ruling from the bench, they argued this in the 'debates on the Constitution' I have the two volume book over their debates and many arguments they had echo our fights today.
scary isnt it how well they understood the judiciary 200+ years ago.

Roe v. Wade was specifically chosen by the USCC. Even your ole Rushie pointed that out. The USCC has already reviewed this case on more than one occasion and declined to interject themselves in the state's jurisdiction.
And, no I specifically did not point out those opposed to the legislation who mispronounced Terri's name, though I did note it. They are not the ones pushing it. If you're going to convene an emergency session of Congress for the sake of one person, I have to say the onus of justification falls on those petitioning for passage.
As for the hospice and Terri's organs, you really are stretching aren't you?

The issue of organs was raised by some doctor being interviewed. It wasn't my idea. But it's still a valid question. That's probably why you don't want to answer. Anyway your spin has become repetitive and transparent which means you've become a bore too so I'll see ya later.

What will probably happen is the federal judge will order the tube re-inserted while he reviews the case. Then he will reach a final decision (which will be protested by somebody, considering how this case has gone so far).
