Federal Judge Strikes Down Religious Exemption to Arkansas Vaccination Law
By James Jefferson Associated Press Writer
Published: Aug 14, 2002

LITTLE ROCK, Ark. (AP) - A federal judge has struck down a religious exemption to a state statute requiring vaccinations before children can attend public school.
The exemption, granted only to members of "recognized churches," violates the establishment and free association clauses of the First Amendment, Judge Susan Webber Wright ruled Tuesday.

The decision left intact the state's vaccination requirement, meaning students still are subject to the requirement with no religious exemption to immunization.

The ruling came in a lawsuit brought by Cynthia Boone, the mother of a student who refused to be vaccinated. The lawsuit said that although Ashley Boone is not a member of a recognized religious group with tenets against vaccinations, she personally believes that vaccinations "are against the will of her God."

Cabot High School officials had barred Ashley from classes during the 2001-2002 school year because she refused to be vaccinated against hepatitis B, a sexually transmitted disease. . . . .

Ever since Scalia gutted the free exercise clause, this type of thing has become mainstream.

How 'bout it, folks? Do we let people walk among us with curable and preventable infectious diseases that endanger us all, because of religious convictions?

My initial thoughts exactly, Fox. The answer is a big negative! If the girl is going to attend this school she has to abide by the same rules/laws as everyone else or the parents have the option of other sources of education. This is a health issue. Thank godness for common sense prevailing in this case.

Hepatitis B is not like the measels.
Viral Hepatitis B... Fact Sheet... click here (http://www.cdc.gov/ncidod/diseases/hepatitis/b/fact.htm)

Why should somebody be forced to take a vaccine for an infectious disease they do not feel at risk of spreading or of contracting??
The Hep B vaccine is recommended for specific groups, including teens (because they are "sexually active.") If a kid says they don't need it... then why make her take it?? If it was my kid... I'd fight like hell defending her decision. Obviously, this is a young lady who is waiting to have sex, is not a junkie, & who is not at risk.
Screw the stupid law.

What does religion have to do with public health?

What does government have to do with public health? If I had known years ago what I know today my children would have never been shot full of holes by the government, especially merely so they could attend the government indoctrination camps. I will agree, however that the indoctrination camps have the right to enforce their own rules. one more reason nobody should go to them.
