The Brains in Black, (BIBs) along with the Tyrants in Black, (TIBs) took the following actions today:

1. Refused to consider banning the execution of criminals who commited their crimes before the age of 18. Although four justices wanted to hear the case, (normally, a sufficient number) the defendant had exhausted his appeals and thus had made his request in an original writ of habeas corpus, which requires five to hear. Justice Stevens wrote a bitter dissent, which was joined by Ginsburg, Breyer, and Souter.

2. Refused to take up an appeal from a death row inmate who claimed that his having to wait almost 30 years for his execution violated the Constitution's ban on cruel and unusual punishment. Breyer wrote a dissent from denial of certiorari. Thomas wrote a separate opinion in which he mocked Breyer's dissent.

3. Refused to decide if police may search a person's vehicle without a warrant if that person did not show them identification or registration. The Court's refusal means that the California Supreme Court's approval of the practice stands.

4. Refused to decide an important conflict between property owners and state governments. The case concerned beach front property on California's coast.

5. Refused to stop a lawsuit accusing Northa Carolina of not providing satisfactory dental care for the poor.

6. Refused to consider reversing a 9th Circuit opinion that freed a man who had been jailed for giving advice to gang members.

7. Refused to decide when groups or candidates may be stopped from running ads. This case came from the Mississippi Supreme Court which had banned the ads. Justice Antonin Scalia had stepped in previously to allow the ads to continue to be shown.

That concludes TIU's High Court Update for Oct. 21st.
