BUSHNELL, Fla.— A Florida man will stand trial for the second time in the shooting death of a kindergartner who died in the back seat of her father's car after a road rage incident escalated into gun fire.
Joshua Walsh, 25, is charged with the third-degree murder of 5-year-old Marishka Lovett. He faces life in prison if convicted.
In 2004, a jury found Walsh guilty of the crime, but a Sumter County circuit court judge ordered a new trial citing possible misinformation given to jurors, according to the Associated Press.
The fatal shooting stemmed from a Feb. 1, 2003, altercation along State Road 466-A in Wildwood, according to the Fruitland Park Police Department.
Tyrone Lovett, 32, and his 5-year-old daughter had driven to Marianna in his Ford Escort to pick up Sandra Vickson, Lovett's mother-in-law. On their way home to Wildwood, Lovett told police, a Trans-Am cut them off.
Savages. Just amputate his arms and legs so he can never harm anyone again. Then set him free. It would be a lot cheaper than imprisonment and a lot more effective in preventing follow-up crimes.
