Scalia Criticizes Politics in Nominations

WASHINGTON - Supreme Court Justice Antonin Scalia on Tuesday predicted an acrimonious confirmation fight over the court's next vacancy and blamed politics for unfilled openings in lower courts.
Scalia said conservatives and liberals created such logjams by supporting activist judges who do not strictly interpret the Constitution.
The justice, who turns 67 next week, frequently complains that the Constitution is treated by courts as a "living document" that evolves over time. He said that Supreme Court decisions involving abortion, the death penalty and assisted suicide illustrate that philosophy.
