I am so happy with the Alito nomination. Unlike Roberts there are no stealthy question marks about this man. He is: a long-time member of the Federalist Society..and a participant; a campus conservative; and open admirer of Anton Scalia.

And from what I've heard, he is a little more direct about his stance. This latest discussion tells me one thing: given a chance Roe v Wade is on the chopping block:

"He gave Specter an unambiguous answer about Roe and Casey.

When Specter asked if the “legitimacy” of the court might be injured “if Roe were overturned,” Alito countered: “I think that the legitimacy of the court would be undermined in any case if the court made a decision based on its perception of public opinion. It should make its decisions based on the Constitution and the law.”

When Specter reminded Alito that Casey “separates out the original soundness of Roe, which had been criticized, and then lays emphasis on the precedential value,” Alito conceded: “There needs to be a special justification for overruling a prior precedent.”

But when Specter asked Alito whether he agreed that “Casey is a super-precedent or a super stare decisis,” Alito stopped him with a quip. “I personally would not get into categorizing precedents as super-precedents or super-duper precedents,” said Alito. “… Any sort of categorization like that sort of reminds me of the size of the laundry detergent in the supermarket.”

Alito concluded by clearly leaving the door open to overturning Roe, noting that stare decisis was not “an inexorable command.”

THIS IS THE GUY THAT WILL OPEN THE DOOR FOR FUTURE CONSERVATIVES! They don't have to "hide" their membership in the Federalist Society, or (like Meirs) say "it might taint me".

If Alito wins, every conservative in America can be proud for dooing their part in telling our leadership to shape up or suffer or wrath.

Max, do you think Alito's IQ is higher or lower then John Roberts ?
Both of them seem smarter then any of the current justices.

Both of them seem smarter then any of the current justices. I suppose given Roberts ranking in law school (no. 1) he is probably an equal of Scalia, but I think Alito is in their league.

Frankly, I think those three (and maybe Thomas) are SO damn impressive that the court liberals will feel like fools. I've already heard Ginsberg up against Scalia in an interview - she was totally outclassed. Liberals souter and Breyer (esp) are smarter, Stevens is too old...and Kennedy is a whimpish, emotional, wiener.

I wish they would follow one recommendation I've heard of: all of them should meet and discuss a case before they vote. If they did that, the morons would be intimidated into following the law.

Don't underestimate its meaning, as DOC says the rats are throwing all they have at Alito. The more than stick their necks out, the closer we get to chopping it off.

Let us pray they try to filibuster...even better if the accomplish it. Then the Gang of 7 - McCain, Graham, DeWine, etc will have to decide whose side they are on...at least we know Graham and DeWine will vote to end filibuters.

I think their "performance" alone has done more to confirm Alito than any of the accolades that his supporters could possible have offered...

Specter had to call Kennedy down yesterday and remind him that Specter was the Chairman of that committee, not Kennedy...

Schummer ended his quetioning today by reading a prepared condemnation that he brought in to the hearings, prepared prior to his own questioning of Alito...

I think that answers Tumble's question...

The Dems are establishing some very dangeroous precedents for Judicial hearings... They are disingenuous, reckless, irresponsible, and as usual, they have no plan...

Remember this folks when we get upset with the pubs. This is what the fight has been about all along, the SCOTUS. Don't loose heart with the pubs, we have two other spots on the SCOTUS that will be opening soon.

However if a half decent Republican wins (not McCain) in 2008 there is an EXCELLENT chance that another conservative or two of some stripe will be appointed. THIS would revolutionize the court.

Still, I can hope that a painless event takes away some of the liberal justices...like a night in a garage with carbon monoxide poisoning...Or a pill induced coma..or ..or ...or....

That's my point. Stevens will be 86 in a couple of months almost 89 when GWB leaves office. The old bird can't hold out forever. Ginsberg will be 73 in a couple of months and has past health problems. If we can put another pub prez in office by the time he gets out one or both of them has to be gone.

Seems to me his fellow Democrats on the panel are embarrassed at his presence.

Agreed. Conservatives had it right in telling Bush that a known conservative could be a legitimate nominee for the Court, if conservatives set aside the specter of Bork and fought for that nominee; certainly liberals make no apologies for nominating their ilk.

I see Alito being confirmed, and this will help keep the right together for the fight this November, and the great fight in 08; liberals have done the math and know as well that they still keep a 5-4 vote on Roe questions, but that would change after 08 if a "conservative" were elected to the White House. As others have pointed out, one if not two seats on the Court will open over the next six years; 08 will cast a long shadow.

I've had only intermittent access to the Net and will continue that way for awhile but I miss FC and hope to be back regularly soon.

I forget the other part *the landmark ruling for homosexual right, now if the court does over turn those case and who know what else, it merely sends it back to the states right? Now another question SCOTUS sends it back, does that mean Congress can outlaw it throughout the land?

If Roe v. Wade is overturned, the issue of abortion will go back to the states where it should be. I suspect that the same would be true for Lawrence (is it Lawrence v. Texas?). The federal government should not be involved in either issue because of the 10th Amendment.

I'm all about states rights... Maybe then some of this social issue stuff will finally be put to rest.. I don't see why a Congressman or Senator should be talking about abortion or gay rights... And yes, its lawrence v. texas, thanks :-) I would rather we choose whats best for us based on our states... Hopefully with the new court, Congress will learn it's lesson and stay out of social issues and then as a nation we can finally focus on whats really important; the economy, national defense and foreign issues..

Yes, the damn federal goverment nannys are keeping us from what is important to the security of this nation.
SCOTUS is the enemy since it makes both partys only worry about social issues. Most SCOTUS Judges like to push their opinion across all 50 states without the peoples consent.

I hope if and when the BS decisions SCOTUS has made get reversed that they will stop legislating morality or the culture war will never end. With states rights the liberals will eventually figure out they can still breathe and will focus on state elections instead of filbusters and pretty much states like CA & NY will be their targets.

USP, I really recommend reading a book called The Politically Incorrect Guide to American History ... real eye opening stuff regarding state's rights. I was able to check out a copy from our county library, perhaps you could see if yours carries it.

That is nice. We should have more individuality amongst us. Congress and SCOTUS will never give us that... If NY, CA, or Mass want to be liberal, so be it.. If Texas or whatever wants to be conservative, go nuts :-) It should be up to the people of each state to decide whats best for them... I know I'm preaching to the choir, but its nice to see people following that same line...
