A shrimp a hibachi chef tossed at a man eating at a Japanese steakhouse ultimately led to the diner's death, his family claims in a $10 million wrongful death lawsuit against the restaurant chain Benihana.

Interesting last name I wonder if they will call this affliction "Colaitis".
Sometimes you get the shrimp and sometimes the shrimp gets you!!

I love Benihana's. Talk about frivilous lawsuits...if the judge doesn't toss this case out and fine the family then he/she should be impeached. Americans have got to stop abusing our courts like this just to make a buck. There are "real" legitimate cases that will have to sit and wait because of crap like this. I think there should be a law that requires people who file frivilous lawsuits to pay all court costs and a fine. A healthy fine. Until we do that these will continue to bog us down.

The technical legal term for this type of lawsuit is: "a bunch of crap."
No foreseeability, no proximate cause. This claim is stillborn.
On an interesting side note, in Illinois at least, if you run a light and injury someone negligently and they go to the hospital and the doctor screws up and kills them, you are liable for the doctor's subsequent malpractice. On the hook for the guy's death. Of course you have an action over against the doc but those are expensive, time-consuming and stacked in favor of the doctor.

And a lawyer named Colaitis... That just screams shyster...!!! I spose that means he's an utter pain in the ass!
