Appeals Court Slaps L.A. Over Arrests of Homeless

Los Angeles' policy of arresting homeless people for sitting, lying or sleeping on public sidewalks as "an unavoidable consequence of being human and homeless without shelter" violates the constitutional prohibition against cruel and punishment, a federal appeals court ruled today.

this goes wll beyond the simple heavy handed stupidity of yesteryears dumb decisions

any twelve year old KID ..SHOULD be able to discern that an arrest aint a PUNISHMENT.

this is truly sad...the heartbreak of psychosis

Arrest is not normally a punishment for those without homes. Heck, we hear stories all the time of homeless people doing something minor to get arrested (in Cinci, they don't just arrest one for simply living on streets or under bridges), just so they had a roof over their heads and some meals.

Although I don't understand it being called a "punishment" in most cases, I certainly don't understand it being called "cruel and unusual."
