Alaskan Judge's Ruling Upholds Legal Possession of Marijuana

JUNEAU, Alaska — A judge on Monday struck down part of a new Alaska law criminalizing possession of small amounts of marijuana, saying it conflicts with past decisions by the Alaska Supreme Court.

Under the ruling, people could legally possess less than an ounce of marijuana in their homes.

The state was expected to quickly appeal to the high court.

Superior Court Judge Patricia Collins said a lower court can't reverse the high court's 1975 decision that said the right to privacy in one's home included the possession of small amounts of marijuana for personal use.........http://www.foxnews.com/story/0,2933,202893,00.html

If she's right, it wasn't she who legalized it.

Three has to be more to this. The way the article reads, she's saying that new laws cannot be passed if a court decides on a previous one that is different. That means the courts would then rule the state, legislature and people be damned.
