At the end of last week, I received a Georgia Supreme Court decision (of April 19) that eliminates individual constitutional rights in the state. The view of the Court is that state power is in no way checked by individual rights. A flimsey pretext can be used to expand the authority of government to any aspect of life; and that individuals have no protection against arbitrary and irrational exercise of that power. Even the separation of powers between branches of government -- the checks and balances system suffered dramatically from the decision. The legislature is now responsible for decisions in individual cases (which it decides en masse), courts act as simple administrative units carrying out the law without any obligation to constitutional principles, and administration within the exectutive branch (bureacracy) does whatever it wishes. The Court actually granted (without question) standing for a state agency to bring suit to "overturn" a private contract. The Court found in favor of the administrative agency, which had no rational (factual) connection to the issue of the suit.
