A surveillance videotape currently playing on YouTube (http://www.wnd.com/redir/r.asp?http://www.youtube.com/watch?v=UW48GC2h_zQ) is giving a "Here we go again!" feel to the decision by prosecutors to charge yet another U.S. Border Patrol Agent, Nicholas Corbett, with murder.

Were I a BP agent, I'd start raising hell amongst my fellow agents, and the result would be a walkout if not a mass resignation. The bullshit of the government constantly siding with the criminals and prosecuting the guys in the war zone—who go to work each day with no certainly that they'll go home that night—for defending themselves is flat-out unacceptable and must cease.

Border Patrol Agent Who Shot Illegal Immigrant Charged With Murder
Updated: April 24th, 2007 02:48 PM EDT

The Arizona Daily Star (Tucson)
BISBEE, Ariz.-- A U.S. Border Patrol agent who fatally shot a Mexican illegal entrant in January has been charged with murder by the Cochise County Attorney who said Monday that the shooting was not justified.
On Monday, Cochise County Attorney Ed Rheinheimer filed a complaint against agent Nicholas Corbett charging him with four counts of homicide: first-degree and second-degree murder, manslaughter and negligent homicide.
Monday's filing comes more than three months after Corbett, 39, shot and killed Francisco Javier Dominguez Rivera, 22, of Puebla, Mexico, on Jan. 12 about 150 yards north of the border between Bisbee and Douglas. The shooting occurred while Corbett was trying to apprehend Dominguez Rivera and three others who were trying to enter the country illegally.
"Based on the extensive investigation presented to this office by the Cochise County Sheriff's Department, as well as the physical evidence itself, we must come to the unfortunate but inescapable conclusion that this shooting was not legally justified," said Rheinheimer in a written statement released Monday.
"The evidence shows that at the time he was shot, Mr. Dominguez Rivera presented no threat to agent Corbett and agent Corbett did not act in reasonable apprehension of imminent death or serious physical injury," the statement says.
A judge will schedule an initial appearance for Corbett likely by the end of the week where conditions of release, including whether bond will be set, will be determined, Rheinheimer said. Then, a preliminary hearing will be scheduled within 20 days, where a judge will decide if there is enough evidence for a trial, and if so, on what charges.
From his home in Cuautla, Morelos, the father of Francisco Dominguez Rivera, Renato Dominguez celebrated the news as the start of a formal process against the Border Patrol agent.
While he had earlier complained at the lack of progress in the investigation, Dominguez Rivera's father said Monday he is pleased at the news the agent has been charged.
"God willing there will be some justice. I am very pleased by this news and I hope that in truth it is a reality and that something good lies ahead. At least it is a good indication tha something has begun," said Dominguez, by telephone in Cuautla, Morelos.
The decision to charge the agent also pleased immigrants' rights advocates, but the Border Patrol union, which has championed Corbett's innocence, was disappointed.
The decision is a part of a nationwide pattern of politically motivated prosecutions against Border Patrol agents, said Brandon Judd, vice president of Local 2544, the Arizona Chapter of the National Border Patrol Council.....http://www.officer.com/article/article.jsp?siteSection=8&id=35836

Let's just say officer Corbett doesn't justifiably shoot Francisco in self-defense and Francisco happens to connect with that "innocent" rock he is standing there with in his aggressive posture. After connecting with officer Corbett's head with this rock and knocking him unconscious, Francisco takes officer Corbett's gun and shoots him in the head. Folks this story never makes the back page of even the smallest newspapers!

That video isn't of Nicholas Corbett. It's of another shooting by BPA Arturo Lorenzo. It's also in California, not in Arizona where the incident with Corbett took place.

Picky, picky, picky. The criminals do what they gotta do.

They may be on the mark with this one. The forensic evidence didn't match the story the agent gave, but it did match with what the witnesses said. I don't put a lot of stock in the testimony of illegals, but forensics are hard to dispute.

Yeah, I was thinking the same thing. We've already dealt with this sort of thing when a police officer shot and killed someone who'd gotten ahold of his taser. The court sided with the officer with the obvious reasoning that the ability to stun or incapacitate an offier (by non-lethal force) would grant access to lethal force via the officer's weapon. Thus lethal force on the part of officer was justified to prevent this.
Personally, were it up to me, we'd have snipers all along that border with a one warning shot policy (that's your chance to turn around). Don't wanna get your self ventilated? Head to a checkpoint the legal way.
We're at war with mexico whether people can see it or not. They (as well as other South American socialist governments) have a policy of conquering America through colonization, via sending millions upon millions of socialist immigrants who's allegiance clearly lies (and remains) with their native country. And just like the war in Iraq the marxist left is doing everything it can to tie the hands of those on the front lines.
