U.S. justices could decide constitutionality of gun ownership

Both sides in a closely watched legal battle over the District of Columbia's strict gun-control law are urging the Supreme Court to hear the case. If the justices agree - a step they may announce as early as Tuesday - the Roberts court is very likely to find itself back on the front lines of the culture wars with an intensity unmatched even by the cases on abortion and race that defined the court's last term.

The question is whether the Second Amendment to the Constitution protects an individual right to "keep and bear arms."

If they have a shred of logic and reason, they will rule that "the people" of the Second Amendment are the same people found in other places in the Constitution.

DC might actually become safe again.

The truth is, owning a gun legally in DC isn't stopping any nut who wanted to assassinate an elected official. You can get illegal guns extremely quick and cheap in any town and city in this nation... the only people this unconstitutional law is hurting are the law abiding residents of DC.

I'm a bit worried. Remember, it was a Roberts Supreme Court that ruled that corporations could use Eminant Domain, not just the government.

Hopefully the Roberts Court will decide to actually READ the constitution before they rule on the Second Amendment rights it guarantees.

I live in the DC metro area, and the city has been booming with gentrification over the past few years. If they get this silly law overturned it will help even more.

It is there as a warning to would-be despots that the people will dismantle their dictatorships with overwhelming firepower. It is there as a warning to scumbags, but it does not have to be there for leaders with a sane and sound mind.

Choose wisely, you public servants in the black robes, and remember that your negative decision will not result in an ounce of difference in the amount of firepower existing.

Correct. The Founders intended the citizens to be armed, to create an "invincible army" of citizens, should the US Government ever become dictatorial. The citizens would then have the means to take back control of the government.

The Second Amendment was intended as our protection against dictatorial politicians government gone bad.

Biggest question here is whether you can get 4 Supremes to vote for a writ of certorari, or "grant cert". Given the controversy of Bush v. Gore, that IMHO makes granting cert a *huge* IF. Consider the ire in some arenas that persists in Bush v. Gore, and multiply that by 100. A 2A decision could affect a majority of Americans.
