Microsoft is no longer obliged to carry Sun's Java code in its Windows platform.
A federal appeals court today threw out a lower court decision which would have compelled the inclusion of the Sun programming language.
Although the decision is a significant victory for the software giant, the court upheld a decision that Microsoft was in breach of a 2001 legal settlement between the companies and had infringed Sun's copyright on Java.
The case now returns to the lower court for further proceedings.
