Duke lax players sue school, city

RALEIGH, N.C. - More than three dozen current and former Duke lacrosse players claim in a lawsuit they suffered emotional distress during the furor over the now-discredited rape case against three of their teammates.

Attorneys planned to file a federal lawsuit Thursday in North Carolina that accuses Duke University, the City of Durham and several school and police officials of fraud, abuse, and breach of duty for supporting the prosecution of the case.

Lead attorney Chuck Cooper said the private university turned its back on the players to protect the school's image.

"These young men want an acknowledgment that they were wronged by institutions and individuals that they trusted to treat them honestly," Cooper said in a statement. Are they going to sue Nifong? Probably wouldn't be worth the trouble, since the poor (as in un-wealthy) sap (as in fool) most likely doesn't have anything of value to take.

The incompetent morons in Durham could have separated themselves from Nifong during his sanctions hearing. They could have said he was a rogue prosecutor acting outside the scope of his authority and thus tried to reduce the city's liability.

Instead the stupid buggers went on record as saying everything Nifong did was essentially OK with the city. Stuart Taylor and other legal analysts laughed at them at the time because they had (a) aid out the lacrosse player's lawsuit against Durham and (b) threw away all available defenses at the same time. Sheer genius.

The city has already had to write very big checks to the kids they prosecuted. I think they will be paying these other guys as well even though their case is tougher to prove than the one by the 3 defendants.

Duke is a private institution, yet it seems to be just as infested with narrow-minded "liberals" (if you'll pardon the oxymoron) as many public colleges and universities. Perhaps if the rich libs who send their kids to that school realize they're not getting their money's worth, they'll change their kids' educational plans and maybe the adminstration there will take notice.

The Duke faculty has no apparent sense of honor. They trashed those kids and the presumption of innocence and have not recanted or apologized. Political correctness means you never have to say you are sorry. Liberals impose moral duties on others. They don't recognize any obligations on themselves other than ideology.

I believe Duke has already settled with the 3 defendants. I think the other lacrosse players have a stronger claim against Duke than against Durham. I would be amazed if this did not settle fairly quickly.

I saw on Instapundit tonite that Duke has moved to shut down the rather innocuous website http://www.dukelawsuit.com/ set up by the attorneys representing the Duke players.

Their claim is that this site might create prejudice against the defendants Duke, the City of Durham and miscellaneous individuals. Amazing. As if they gave a rat's ass about prejudicing the criminal proceeding against these kids with their own outrageous actions. What hypocrisy.

Mike Nifong is a rapist who should be behind bars for the rest of his life. He raped the reputations of men who had committed no crime, he raped the taxpayers of North Carolina, and worst of all he raped the justice system and he raped the Constitution.

I hope this lawsuit bankrupts Puke University and forces it to shut down. The abandoned buildings of the former Puke University campus will serve as a lesson to any other university that rushes to join a lynch mob.

False accusations of rape do tremendous damage to the ability to prosecute the real ones. Mike Nifong, by abetting a false accuser, may very well indirectly cause real harm to actual victims.

But the faculty will never apologize. The school will not sanction those individual professors and administrators who actions cost them money. They will simply expect donors and tuition-payers to cover any losses. Liberal accountability at work.
