This is ridiculous. What if after he showed her the gun he was going to take her to the abortuary to commit feticide? Would he be charged then? Would anybody be charged in the death of the fetus?

This is exactly why this isn't an issue for state's rights, imho. Either we respect the sanctity of life, or we get conflicting situations just like this. The DoI says we are endowed by our Creator with certain unalienable rights, that among these are LIFE, liberty and the pursuit of happiness. There simply is no other way to interpret that phrase except to say we all have the right to be born, because liberty and the pursuit of happiness have to do with how we live that life.
