“It shouldn’t be up to a judge to tell me whether or not I was raped,” Bowen said. “I should be able to tell the jury in my own words what happened to me.”

Bowen’s case is part of what some prosecutors and victim advocates see as a national trend in sexual assault cases.

Sooo...if someone beat this PoS severely about the head and shoulders with a bat, the words "physical assault", "battery" and "malicious intent" would be banned from the court proceedings. Correct? In their place would be, "cranial/scapular drum solo", "extreme petrissage" and "application of common sense" would be inserted.

If the point of the trial is to determine whether a rape occurred (e.g., William Kennedy Smith (http://en.wikipedia.org/wiki/William_Kennedy_Smith)), then it should not be mentioned. If the point of the trial is to determine whether the defendant is the rapist, then it should be allowed.
