A constitutional carcass is all that's left for America.

Let's ponder these questions: Why did Congress amend the Constitution in 1916, giving it the power to collect taxes on any source? Why was the 17th Amendment enacted in 1913 to select senators by popular vote rather than, as originally designed, by state legislatures? Finally, why did Congress pass the 18th Amendment in 1919, outlawing alcohol sales?

To really get into these questions and gain an appreciation for today's rogue Congress and Supreme Court, let's not get bogged down on the merits of these amendments. Let's simply look at the Constitution's restrictions. In Article I, Section 8 of the Constitution, the framers enumerated 18 functions of the federal government. Nowhere among those functions was Congress given the power to prohibit alcohol sales.

Article I, Section 2 of the Constitution states "direct taxes shall be apportioned among the several states" and forbids direct taxes on individuals. Then there's Article I, Section 3, which requires state leg islatures to appoint senators.

During earlier periods, Congress and the Supreme Court had far greater respect for the Constitution. They understood that if the federal government was to have a power not delegated, or expressly forbidden, by the Constitution, they had to gain that power by amendment.

They knew that Congress had not been delegated power to prohibit alcohol sales. They couldn't find that power by manipulating the 'commerce clause" or going penumbra hunting.

Today, it's an entirely different story. Congress, the White House and the Supreme Court have abiding contempt for the Constitution and we Americans are left with a constitutional carcass.

Take just a tiny comparison of today with yesteryear. Yesteryear, there were alcohol prohibitionists; today, we have tobacco prohibitionists. No matter what we think about the alcohol prohibitionists, we can admire them because they used the constitutional route to get their agenda across.

Tobacco prohibitionists employ constitutional stealth: taxes, majority votes and the totalitarian tactics of the Environmental Protection Agency and the Food and Drug Administration.

In 1787, the Constitution would have never been ratified without both the Ninth and 10th Amendments. "The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the n- people" is the Ninth Amendment, and "Powers not delegated to the United States by the Constitution, nor prohibited by it to the states, are reserved to the states respectively, or the people" is the lOth.

The framers justifiably feared concentration of power in Washington. Today, the Ninth and lOth Amendments have been completely trashed, and Congress is well on the way to finally trashing the Second and Fifth Amendments.

When and how we developed today's constitutional contempt is debatable. The federally caused Great Depression played a role, but the education establishment has played a greater role through the dumbing down of Americans. The resulting ignorance has allowed us to let charlatans and quacks in the legal profession tell us what the Constitution means. The Constitution was not written for intellectual elites; it was understandable to a nation of mostly farmers at the time it was written.

So where do we go, and what do we do? Each of us is duty-bound to read and understand our Constitution. If we do that, we'll realize Washington has little or no moral authority. Its authority rests mostly on intimidation and force of of arms.

And like the founders, we should adopt the attitude that "There is one thing in the world more wicked than the desire to command, and that is the will to obey."

Several ways.

#1 Enough people "wake up" to our eroding rights, and start raising pure hell to overturn a bunch of these "laws".
#2 A successfully fought and won Second Revolutionary War.

Even to a cantankerous, broken down, ugly old warhorse like me... #1 is the preferrable course.

It isn't a foregone conclusion "we" would successfully return to the Founder's intent, even given we "win" such a War. Likely, we'd have some group seize power, and we'd have a Military Dictatorship anyway.

My $0.02 worth...

I think, you're wrong.

Being a foreign I see America's problem different way.

First; America "did" prosper because there was not much Religious/Liberal interference in government duties. But after America's first major recession, FRD put America into a socialist direction. (Today; every major accountable company - in the pocket of the federal government) The Labor Union is nothing else, then K9 teeth for liberalism.

Second: Education is all about politics, liberal pushers. Purposely destroying children by pushing chocolates on them, make them hyper, ready for cigarette, alcohol & drugs. Sex education make totally confused between right and wrong, between decency & fidelity.

Third: Intelligent & seems educated people can't see the common (widely known fact) today SPECIAL INTEREST is the one controlling the politics of United States of America. They can't lower taxes, because the politicians wont let to do! It is the most dishonest business is the federal government - and I see, it mostly begin under Preident Clinton.

Befor that; "only" congress (democrats created the pig barrel) but today they are all corrupted.

People! I'm willing to help, but it will take a major u-haul. We must begin with the simple step - war against ADDICTION! Hopfully not addicted people will be sober to select representatives. Wont be easily influenced by special interest groups.

Every organization with large capital like; Religion, Union, School system, major corporations on federal doe (corporate welfare); GM, GE, AT&T, Ford, etc are all Liberal pushers.

... and this is were I came from. Educated people are not obey, they do (know) they responsibilities, duties!

It is a Religious/Liberal strategy (carefully worked out plan) make them stupid, divide & control (rule) them.

People!

I would like to tell you a seriouse definition - Every law are (only) protecting special interest!

Therefor; if you break any of "they" law, you end up with a lots of liberal demonstrators or police - after you.

I'm been around some time and I lived through some tough time including "revolution" and I remember there was a common phrase "We can't have law-less-ness"

Today I know - lawlessness is/are old religious demand they own right. Including property right, tax-free, etc.

Other; when President Reagan start to cut (dismiss) some foolish laws - that was an unforgiveable sin by liberals. And that is the reason, today no liberal talk favorable about President Reagan - one of our greatest president.

Yes; animals, uneducated & addicted people need some laws (cordons) to follow.

Educated, none addicted people need entrepreneuers, freedom, free borders to spread education & goods!

Army, borders, laws are the left over from "Religious Ruled" They called it - the dark age.

First of all, there is NO miracle! Well; there are things happan, which "some people with they little mind" can't understand, therefor it's a miracle for them.

Second; if we wish to understand the problems of today, we must analyze "yesterdays"

Today: Education is down, down, down.

Today: Religious - up by 80 or 100% (3-4 years ago they said Religious is up by 80%)

Today: President Clinton's criminal act was well known from the very beginning and they sailed through "two times" with his election.

Maggie - is this an alarm call for re-examen your knowledge? Your past study?

Evolution is to learn! Nature is everything! The "Mighty" the teacher, the example, the power, the beauty.

We Are All Brothers & Sisters. With all the animals, threes, flowers & fishes. (If I could explain it to a school teachers of today - I would be the winner)
